Property Description:<br>
Property is located at 11360 Schenk Rd. Sidney, Ohio and contains 25.300 Acres MOL in 1 parcel with the improvements of a frame home, detached outbuildings and pond. Shelby County Parcel # 58-26-09-300-003. <br>

AUCTION PROCEDURE: The real estate will be offered On-Site at a Live auction event on the 25th. day of June at 11:30 A.M. The Property will sell to the highest bidder with estate confirmation.<br>

BUYER’S PREMIUM: A 10% buyers premium will be added to the highest bid to establish the full contract price. For instance if your high bid was $ 150,000.00 + 10% or $ 15,000.00 your total contract price would be $ 165,000.00.<br>
<br>
DEPOSIT: $ 10,000.00 shall be required the day of the auction as good faith earnest money. This deposit shall be made payable to Re/Max One Realty and will be held in Escrow until successful closing at which time it will be returned to the buyer.<br>

ACCEPTANCE OF BID PRICES: The successful bidder will be required to enter into a NON CONTINGENT MEMORANDUM OF <br>
AUCTION SALE AGREEMENT with the sellers the day of the auction. Your bidding is considered to be a binding contract. <br>

TITLE: At closing the seller shall convey marketable title to the property free and clear of all liens and encumbrances. If the seller’s title is found to be defective the seller shall have the right to remedy the defect within 60 days. If this cannot be done, then, at the option of the buyer, the deposit shall be returned and the auction sale terminated.<br>

CLOSING & ADDITIONAL EXPENSES: The full purchase price is due at closing, which shall take place no later than July 26th. 2016. The closing shall be conducted at Lawyers Title Agency 100 Courtview Center Sidney, Ohio. The purchaser shall be responsible for the payment of the Transfer tax due to the Shelby County Auditor. This tax is $ 4.00 per thousand of the total contract price. Additionally purchaser shall pay a closing fee of $ 175.00 to Lawyers Title Agency.<br>

POSSESSION: Possession of the home and non-tillable acreage shall be granted upon recording of the deed. Possession of the tillable ground shall be granted upon the removal of the current years crop in the fall. Tillable acreage is currently being farmed on a 50/50 profit basis. Final payment after removal of the crop will be split equally between the new owner and the estate.<br>

REAL ESTATE TAXES, UTILITIES: Current Real estate taxes are $ 2,073.60 per year. Property is in the CAUV program. Any re-coupment due to change of use shall be the responsibility of the purchaserer. Real estate taxes and assessments shall be pro-rated to the day of closing using the long pro-ration method customary in Shelby County. The seller shall pay all accrued utility bills to the date of closing. <br>

LEAD PAINT CONTINGENCY: Buyer will waive all contingencies based upon a risk assessment or inspection of the premises for the presence of lead based paint and/or lead based paint hazards, and will receive the pamphlet “ Protect your family from lead in your home “.<br>
