AUCTION PROCEDURE: The real estate will be offered as one unit subject to owner confirmation at On-Line Auction ending Thursday March 17th. 4:00 P.M. The On-Line auction will utilize the “soft close” method for bidding.<br>
BUYER’S PREMIUM: A 5% buyer’s premium will be charged. This buyer’s premium will be added to the final high bid to determine total contract price.<br>
ACCEPTANCE OF BID PRICE: The successful bidder will be notified within 1 hour of the close of the auction as to whether their high bid along with buyer’s premium was accepted. Upon acceptance the successful bidder will be be required to enter into a NON CONTINGENT MEMORANDUM OF AUCTION SALE AGREEMENT with the sellers on Friday March 19th. 2016 before 5:00 P.M. at the Re/Max One Real Estate Office located at 216 East Poplar Street Sidney, Ohio. Your bidding is considered to be a binding contract. In the event of failure to execute the Memorandum of Auction Sale Agreement stated above the buyer shall be in breech of contract and appropriate legal action my ensue. <br>
DEPOSIT: $ 10,000.00 shall be required at the signing of the Memorandum of Auction Sale Agreement as good faith earnest money. Payment may be made in the form of Cash, or Check. This deposit shall be made payable to Re/Max One and will be held in Escrow until closing at which time it will be returned to the buyer.<br>
TITLE: At closing the seller shall convey marketable title to the property free and clear of all liens and encumbrances in the form of a general warranty deed. If the seller’s title is found to be defective the seller shall have the right to remedy the defect within 60 days. If this cannot be done, then, at the option of the buyer, the deposit shall be returned and the auction sale terminated.<br>
